Terms and conditions

These terms are an agreement between you and PC3 Media Group LLC ("we", "us") for using the myCE app and trackmyce.io. By creating an account or using myCE, you agree to them and to our privacy policy. If you don't agree, please don't use myCE.

1. Who can use myCE

You must be at least 18 and able to enter into this agreement. The information you give us must be accurate.

2. Your account

You sign in with Apple or Google. You're responsible for keeping those accounts and your phone secure, and for what happens under your account. Tell us at support@trackmyce.io if you think someone else has gotten in.

3. What myCE is and isn't

myCE is a tool for capturing, organizing, tracking, and sending your training and employment records. It isn't a licensing board, an accreditor, a government agency, or an official system of record, and it doesn't give medical, legal, or career advice.

A "verified" record was issued through an instructor's class in myCE. It doesn't mean we've checked the instructor's authority, the course, or the credential.

Goals, hour counts, and deadlines are there to help you. Requirements vary and change, so check them with your licensing body or employer. See liability and disclaimers.

4. Your records and content

What you add to myCE stays yours. You give us permission to handle it only as needed to run myCE for you. We don't sell it, use it for advertising, or use it to train AI models.

You confirm that you have the right to add what you add, and that it's accurate to the best of your knowledge.

Keep your own copies. The app stores records on your iPhone. If your phone is lost or erased without a backup, we can't recover them. Keep your original certificates, and export your data from time to time.

5. Rules

You agree not to:

• add patient health information, or anything else you aren't legally allowed to share;
• create, alter, or send records you know are false, or use myCE to misrepresent your training or qualifications;
• pretend to be someone else, including an instructor;
• break the law, or harass, defraud, or harm anyone;
• get into other people's accounts or data, interfere with myCE, or upload malicious code;
• copy or reverse engineer myCE, except where the law allows it; or
• infringe anyone's rights.

If you find a security problem, please report it to security@trackmyce.io and give us a chance to fix it before sharing it.

6. Instructors

Instructor tools are free. Use them only for classes you're authorized to teach, and mark attendance and hours truthfully. You're responsible for your classes, your rosters, and the records you issue, and for how you handle students' names and details.

Instructor status isn't an endorsement by us, Apple, or Google. We may review instructors, and we may remove instructor access if we receive credible reports of misuse.

7. Free plan and subscription

• You can save up to 5 records for free, of any kind.
• myCE Unlimited removes that limit for $1.99 a month in the US. Prices may vary by country and are shown before you buy.
• Apple charges your Apple account when you confirm. The subscription renews every month unless you cancel at least 24 hours before the current period ends.
• You can cancel in your iPhone's Settings: tap your name, then Subscriptions. Canceling takes effect at the end of the period you've paid for. Deleting the app or your myCE account doesn't cancel it.
• Refunds are handled by Apple under its rules, at reportaproblem.apple.com.
• If we change the price, you'll be told in advance as Apple's rules require.

If your subscription ends, your records aren't locked. You can still view, edit, export, and delete everything. You just can't add more records past the free limit.

8. Other services

myCE works with services we don't control, including Apple, Google, and whatever you use to send a bundle. Their own terms apply, and we aren't responsible for them.

9. Our rights

myCE, including its software, design, name, and logo, belongs to us and our licensors. We give you a personal, limited, non-transferable, revocable license to use it under these terms. If you send us ideas, we can use them without paying you or owing you anything.

10. Ending your account

You can stop using myCE at any time, and you can delete your account in the app. We may suspend or close access if you seriously or repeatedly break these terms, if the law requires it, or to protect people or the service. Where it's reasonable, we'll tell you first and give you a chance to export your data. Parts of these terms that should naturally continue, such as sections 11 to 14, continue after your account ends.

11. Disclaimers

MYCE IS PROVIDED "AS IS" AND "AS AVAILABLE." TO THE EXTENT THE LAW ALLOWS, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ACCURACY. WE DON'T PROMISE THAT MYCE WILL BE UNINTERRUPTED OR ERROR-FREE, THAT TEXT READ FROM A DOCUMENT, A GOAL, AN HOUR COUNT, OR A DEADLINE WILL BE CORRECT, THAT A REMINDER WILL ARRIVE, THAT YOUR DATA WON'T BE LOST, OR THAT ANY LICENSING BODY, ACCREDITOR, EMPLOYER, OR AGENCY WILL ACCEPT A RECORD OR BUNDLE.

12. Limitation of liability

TO THE EXTENT THE LAW ALLOWS, WE AND OUR OWNERS, OFFICERS, EMPLOYEES, AND AGENTS AREN'T LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, WAGES, EMPLOYMENT, DATA, OR GOODWILL, OR FOR A LAPSED, DENIED, OR SUSPENDED LICENSE OR CERTIFICATION, ARISING FROM MYCE OR THESE TERMS. OUR TOTAL LIABILITY FOR ANY CLAIM IS LIMITED TO THE GREATER OF $100 OR WHAT YOU PAID FOR MYCE IN THE 12 MONTHS BEFORE THE CLAIM.

Some places don't allow some of these limits, so they may not all apply to you. Nothing in these terms limits rights that the law says can't be limited.

13. Indemnity

If someone brings a claim against us because of your content, your classes or issued records, or your breaking these terms or the law, you agree to cover our reasonable costs from that claim, to the extent the law allows.

14. Disputes

If you have a problem with myCE, please write to support@trackmyce.io first. Most things can be sorted out that way.

These terms are governed by the laws of the State of Washington, USA, without regard to its conflict-of-laws rules. Any dispute we can't resolve informally will be handled in the state or federal courts located in Washington, and you and we agree to their jurisdiction. If the law where you live gives you the right to bring claims in your own courts, that right isn't affected.

15. If you got myCE from the App Store

These additional terms apply, and they take priority over anything different above for your App Store copy. They're between you and us. Apple isn't a party to them.

• Your license is to use myCE on Apple devices you own or control, as the App Store's Usage Rules allow.
• We, not Apple, are responsible for myCE and its content, and for providing maintenance and support. Apple has no obligation to do so.
• If myCE fails to meet a warranty that applies to it, you can tell Apple, and Apple will refund the purchase price, if any. To the extent the law allows, Apple has no other warranty obligation for myCE.
• We, not Apple, are responsible for handling claims about myCE, including product liability, failure to meet a legal requirement, and consumer protection claims.
• If someone claims that myCE infringes their intellectual property, we, not Apple, are responsible for investigating and handling that claim.
• You confirm that you aren't in a country under a US government embargo or designated as supporting terrorism, and that you aren't on a US government list of prohibited or restricted parties.
• You must follow any third-party terms that apply when you use myCE.
• Apple and its subsidiaries are third-party beneficiaries of these terms and can enforce them against you.

16. Changes and the rest

If we make a change to these terms that matters, we'll tell you in the app before it takes effect. If you keep using myCE after that, the new terms apply. If any part of these terms can't be enforced, the rest still applies. If we don't enforce something right away, we can still enforce it later. You can't transfer these terms without our consent, but we can transfer them as part of a merger or sale. These terms are the whole agreement between us about myCE.
